The Freelance Contract Mistake That Costs You Clients

There's one clause most freelancers leave out of their contracts that causes more lost revenue, scope creep, and bad-fit clients than anything else. It takes two sentences to fix — and once you add it, you'll wonder how you ever worked without it.

The Missing Clause: Change Order Language

Most freelance contracts define deliverables. Very few define what happens when a client asks for something outside those deliverables.

Without a change order clause, you have two bad options when a client asks for "one small thing extra": do it for free and resent them, or push back and look difficult. Neither is good for the relationship or your business.

With a change order clause, you have a third option: "That's outside our original scope — here's what adding it looks like." The client isn't surprised, you're not angry, and the project stays on budget.

What the Clause Should Say

You don't need legal language. You need two things:

  1. A definition of what counts as a change (anything not listed in the deliverables section)
  2. A process for handling it (client requests change in writing, you send a revised quote, work begins after approval)

Something like: "Any work outside the scope described in this agreement requires a separate written change order with updated pricing and timeline, approved by both parties before work begins."

That's it. Two sentences.

The Second Mistake: No Kill Fee

Projects get canceled. Sometimes it's the client's budget, sometimes it's internal politics, sometimes it's cold feet. Without a kill fee, you walk away with nothing for weeks of work.

A standard kill fee is 25–50% of the remaining project value if the client cancels after work has begun. Include it. Clients who push back on a kill fee are showing you who they are before you've started.

How to Bring It Up

The best time to introduce contract terms is before the proposal is accepted — not after. "Here's my standard agreement" is a normal part of a professional engagement. If a client refuses to sign a contract, that's the answer.
